These Terms and Conditions ("Terms") govern your access to and use of the MediaShelf website and related services.

Unless expressly stated otherwise, purchasing digital Content does not transfer copyright, ownership, or other intellectual-property rights in that Content to you.

9. Digital Content Access

Access to Paid Content may depend on your MediaShelf account and successful verification of your purchase.

MediaShelf may use purchase records to determine whether your account is authorized to access particular Paid Content.

You must not attempt to bypass, disable, manipulate, or circumvent technical restrictions used to protect Paid Content.

You must not attempt to obtain Paid Content without completing the required purchase or authorization process.

10. Payments

Payments for Paid Content may be processed through third-party payment providers.

MediaShelf may receive information necessary to confirm a transaction, such as:

  • Transaction ID
  • Payment status
  • Amount
  • Currency
  • Purchase date
  • Purchased Content

Payment providers may apply their own terms, fees, limitations, and privacy policies.

MediaShelf is not responsible for failures caused by a payment provider, banking institution, card issuer, payment network, or other external financial service.

11. Refunds and Cancellations

Because music and digital books are digital products, access may begin immediately after a successful purchase.

Where permitted by applicable law, digital Content that has already been accessed, streamed, downloaded, or delivered may not be eligible for a refund.

However, MediaShelf may consider refund requests in circumstances such as:

  • Duplicate charges
  • Failed or incomplete transactions
  • Technical problems preventing reasonable access to purchased Content
  • Unauthorized transactions
  • Other circumstances where a refund is required by applicable law

Any refund request should be submitted through our contact or support channels with relevant transaction information.

Nothing in these Terms is intended to remove any mandatory consumer rights that apply to you under applicable law.

12. Google Drive and Third-Party Cloud Storage

MediaShelf may use Google Drive and other third-party cloud infrastructure to store, manage, or deliver digital Content.

Music files, book files, cover images, thumbnails, and other digital assets may be stored using these services.

Because third-party infrastructure is involved, temporary interruptions may occur due to:

  • Cloud-service outages
  • Network problems
  • Maintenance
  • Storage limitations
  • Technical failures
  • Security events
  • Changes to third-party services

MediaShelf will make reasonable efforts to maintain access to the Service but does not guarantee uninterrupted availability of Content stored or delivered through third-party infrastructure.

13. License to Use MediaShelf

Subject to your compliance with these Terms, MediaShelf grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service for its intended purposes.

This license does not give you ownership of:

  • MediaShelf's software
  • Website design
  • Trademarks
  • Branding
  • Copyrighted website content
  • Music
  • Books
  • Artwork
  • Other intellectual property

You may not reproduce, distribute, sell, sublicense, publicly exploit, or commercially exploit MediaShelf's proprietary materials without appropriate authorization.

14. Restrictions on Use

You agree not to misuse MediaShelf.

You must not, except where expressly permitted by law or authorized by MediaShelf:

  • Copy or redistribute Paid Content
  • Sell or commercially redistribute Content obtained through MediaShelf
  • Share paid-content access with unauthorized users
  • Attempt to bypass payment restrictions
  • Circumvent technical protection measures
  • Scrape or systematically collect website data without permission
  • Reverse engineer the Service
  • Attempt to gain unauthorized access to accounts or servers
  • Upload malicious software
  • Interfere with the operation of the website

19. Availability of the Service

We attempt to keep MediaShelf available and functioning properly.

However, we do not guarantee that the Service will always be:

  • Uninterrupted
  • Secure
  • Error-free
  • Free from technical problems
  • Compatible with every Device
  • Free from delays

The Service may occasionally be unavailable because of maintenance, upgrades, technical problems, hosting issues, cloud-storage issues, network failures, security incidents, or circumstances beyond our reasonable control.

21. Account and Service Termination

  • You misuse Paid Content
  • You infringe intellectual-property rights
  • You interfere with the Service
  • Your activity creates a security risk

Upon termination, your right to use the Service may cease immediately.

Termination does not necessarily eliminate obligations that arose before termination.

22. Effect of Termination on Purchases

If an account is terminated because of fraud, abuse, unauthorized access, copyright infringement, or serious violations of these Terms, access to purchased Content may be restricted where permitted by applicable law.

Nothing in this section is intended to remove mandatory consumer rights or refund rights provided by applicable law.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MediaShelf provides the Service and Content on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee that:

  • The Service will be uninterrupted
  • The Service will be error-free
  • Content will always remain available
  • Content will always be accurate or complete
  • Third-party cloud storage will always operate without interruption
  • Payment services will always be available
  • The Service will work on every Device
  • Technical errors will always be corrected
  • The Service will meet every user's particular requirements

To the maximum extent permitted by applicable law, we disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, MediaShelf and its service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.

This may include losses resulting from:

  • Loss of data
  • Loss of profits
  • Business interruption
  • Loss of access to Content
  • Service interruptions
  • Third-party service failures
  • Cloud-storage outages
  • Payment-provider failures
  • Unauthorized access
  • Device problems
  • Network problems

To the maximum extent permitted by applicable law, the total liability of MediaShelf relating to a claim arising from the Service shall be limited to the amount you actually paid to MediaShelf for the relevant transaction giving rise to the claim.

If you have not paid for any relevant Service or Content, the maximum aggregate liability shall, to the extent permitted by applicable law, be limited to USD 100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

25. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MediaShelf and its operators, service providers, and representatives from claims, damages, liabilities, costs, and expenses arising from:

  • Your violation of these Terms
  • Your unlawful use of the Service
  • Your infringement of another person's rights
  • Your unauthorized distribution of Content
  • Your misuse of Paid Content
  • Content you submit to the Service
  • Your violation of applicable laws

26. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in Pakistan, without regard to conflict-of-law principles, except where mandatory consumer-protection laws provide otherwise.

Your use of MediaShelf may also be subject to other applicable local, national, or international laws.

27. Dispute Resolution

If you have a concern or dispute regarding MediaShelf, you agree to first attempt to resolve the matter informally by contacting us.

We will make reasonable efforts to review and respond to legitimate complaints.

Nothing in this section prevents you from exercising rights that cannot legally be waived under applicable law.

28. International Users

MediaShelf may be accessible from countries outside Pakistan.

If you access the Service from another country, you are responsible for ensuring that your use of the Service complies with applicable laws in your jurisdiction.

Certain Content or features may not be available in every country.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or interpreted to the maximum extent permitted by applicable law.

The remaining provisions shall continue in full force and effect.

30. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

A waiver of one breach does not constitute a waiver of any subsequent breach.

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into the Service, constitute the agreement between you and MediaShelf regarding your use of the Service.

These Terms replace prior versions relating to the same subject matter unless otherwise stated.

32. Translation

These Terms may be translated into other languages for convenience.

If there is a conflict between a translated version and the English version, the English version shall prevail to the extent permitted by applicable law.

33. Changes to These Terms

MediaShelf may update these Terms from time to time.

When changes are made, we will update the "Last updated" date at the top of this page.

For significant changes, we may provide additional notice through the website, email, or another appropriate method where reasonably appropriate or legally required.

Your continued use of MediaShelf after revised Terms become effective constitutes acceptance of the revised Terms.

If you do not agree with the revised Terms, you should stop using the Service.
